New South Wales Fair Trading
New South Wales Fair Trading is the state government agency responsible for residential tenancy regulation in New South Wales. It administers the Residential Tenancies Act 2010 (New South Wales), publishes mandatory tenant and landlord information, and operates Rental Bonds Online for bond lodgement and refund.
New South Wales Fair Trading sits within the New South Wales Department of Customer Service and is the regulator landlords, agents, and tenants deal with for residential tenancy compliance in the state. It administers the Residential Tenancies Act 2010 (New South Wales) and the Residential Tenancies Regulation 2019, including rent-increase rules, termination notices, prescribed forms, condition reports, and the no-grounds-eviction reforms phased in from 19 May 2025.
Bonds for New South Wales tenancies are not held by Fair Trading itself but lodged via Rental Bonds Online, the state-run digital bond service. Disputes that cannot be resolved between the parties are heard by the New South Wales Civil and Administrative Tribunal (NCAT), which can order bond release, rent reductions, repair completion, termination, and compensation. Fair Trading provides free dispute-resolution information and tenancy guidance but does not adjudicate disputes itself.
Landlords should keep a clean evidence trail aligned to Fair Trading’s published checklists: tenancy agreement using the prescribed form, rental bond receipts, condition report at start and end of tenancy, rent-increase notices with required notice periods, repair requests and responses, and any tribunal orders. The same evidence supports an Australian Taxation Office rental-deduction position at end of financial year.
